When you place an order through dionspizza.top, you are making an offer to purchase the selected food products at the prices and on the terms stated at the time of ordering. All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to product unavailability, errors in product descriptions or pricing, suspected fraud, or other legitimate business reasons.
5.2 Pricing
All prices displayed on our Site are in United States Dollars (USD) and are subject to change without notice. Applicable taxes, delivery fees, and service charges will be calculated and disclosed to you prior to order confirmation. Promotional prices are valid only for the duration of the promotion and cannot be combined with other offers unless expressly stated.
5.3 Payment
We accept various forms of payment as indicated on our Site at the time of checkout. By submitting your payment information, you:
- Represent that you are authorized to use the designated payment method;

We use third-party payment processors and do not store full credit or debit card details on our servers. All payment transactions are secured using industry-standard encryption technology.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final once an order has been confirmed and preparation has commenced. If you experience an issue with your order — including receiving incorrect, damaged, or unsatisfactory items — please contact us immediately at [email protected]. We will evaluate your concern and, at our sole discretion, offer a refund, replacement, or store credit as an appropriate remedy.
5.5 Delivery
Estimated delivery times are provided as a convenience and are not guaranteed. Actual delivery times may vary depending on factors such as order volume, weather conditions, and delivery area. We shall not be liable for delays caused by circumstances beyond our reasonable control.
6. Intellectual Property Rights
All content, materials, and intellectual property available on or through dionspizza.top, including but not limited to text, graphics, logos, icons, photographs, audio clips, digital downloads, data compilations, software, and the overall "look and feel" of the Site, are the exclusive property of Dions or its content licensors and are protected by applicable United States and international intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.) and the Lanham Act (15 U.S.C. § 1051 et seq.).

Any unauthorized use of our intellectual property terminates the license granted herein and may constitute a violation of applicable law, entitling us to seek injunctive relief and monetary damages.
6.2 User-Submitted Content
If you submit reviews, feedback, photographs, or other content to us through our Site or social media channels, you grant Dions a royalty-free, perpetual, irrevocable, worldwide, non-exclusive license to use, reproduce, modify, publish, and distribute such content for any lawful business purpose, including marketing and promotional activities. You represent and warrant that you own or have the necessary rights to grant this license and that your submitted content does not infringe upon any third party's rights.
7. Food Safety, Allergen Information, and Health Disclaimers
We take food safety seriously and comply with applicable federal and state food safety regulations, including those enforced by the U.S. Food and Drug Administration (FDA) and relevant state health departments. However, you acknowledge the following:
- Our food products are prepared in a kitchen environment where common allergens — including but not limited to gluten, dairy, eggs, tree nuts, peanuts, soy, shellfish, and fish — may be present;
- While we strive to provide accurate allergen and nutritional information, cross-contamination may occur, and we cannot guarantee that any menu item is completely free from allergens;
- If you have severe food allergies, dietary restrictions, or specific health conditions, we strongly encourage you to contact us directly at [email protected] before placing an order;
- Caloric and nutritional information provided on our Site is based on standard recipes and may vary depending on preparation methods, ingredient substitutions, or portion sizes;

We have no control over the content, privacy practices, or terms of third-party sites and shall not be responsible or liable for any loss or damage arising from your use of any third-party site or service. Your interactions with third parties are governed solely by the terms and policies of those third parties.
9. Disclaimers — Services Provided on an "As-Is" Basis
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE AND ALL SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DIONS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED ON THE SITE;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.
We do not warrant that the quality of any products, services, information, or other material obtained through our Site will meet your expectations.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL DIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
- LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES;
- PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE ARISING OUT OF YOUR ACCESS TO OR USE OF OUR SITE OR SERVICES;
- UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS OR PERSONAL INFORMATION STORED THEREIN;
- ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED TO OR THROUGH OUR SITE BY ANY THIRD PARTY;
- ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SITE.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
IN ALL EVENTS, DIONS'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
11. Indemnification
You agree to defend, indemnify, and hold harmless Dions and its officers, directors, shareholders, employees, independent contractors, agents, successors, and assigns (collectively, the "Dions Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees and court costs) arising from or relating to:
- Your access to or use of our Site or services;
- Your violation of any provision of these Terms;

- Any content you submit, post, or transmit through our Site;
- Any fraudulent activity or misrepresentation on your part;
- Any dispute between you and a third party arising in connection with your use of our services.
We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate with our defense of that claim. This indemnification obligation shall survive the termination of these Terms and your use of our services.
12. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and applicable state law, without regard to any conflict of law principles that would cause the application of the laws of any other jurisdiction.
For matters related to consumer protection, the Federal Trade Commission Act (15 U.S.C. § 45 et seq.) and applicable state consumer protection statutes shall apply. For users located in California, the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) may provide additional rights with respect to personal information.
Any legal action or proceeding arising under or relating to these Terms that is not subject to arbitration as described in Section 13 shall be brought exclusively in the federal or state courts located in the United States, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact Dions at [email protected] and provide a written description of your dispute, including the nature of the claim, the relief sought, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receiving your written notice. If we are unable to resolve the dispute within that period, either party may pursue formal dispute resolution as described below.
13.2 Binding Arbitration
Except for claims that qualify for small claims court, any dispute, controversy, or claim arising out of or relating to these Terms, including any question of their breach, existence, validity, or termination, shall be finally resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA) then in effect for consumer disputes. The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
The arbitration shall be conducted on an individual basis. YOU AND DIONS EACH WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR CLASS-WIDE ARBITRATION. You may not bring a claim as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
13.3 Exceptions to Arbitration
Notwithstanding the foregoing, the following claims are not subject to binding arbitration:
- Claims that qualify for small claims court jurisdiction;
- Claims for emergency injunctive or other equitable relief to protect intellectual property rights or prevent irreparable harm;
- Claims arising under applicable consumer protection statutes that specifically prohibit pre-dispute arbitration agreements.
13.4 Waiver of Jury Trial
TO THE EXTENT ANY DISPUTE IS NOT SUBJECT TO ARBITRATION, YOU AND DIONS EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL. THIS WAIVER IS SUBJECT TO APPLICABLE LAW AND MAY NOT BE ENFORCEABLE IN ALL JURISDICTIONS.
14. Term and Termination
14.1 Term
These Terms shall remain in full force and effect from the date you first access our Site or use our services until terminated as described in this section.
14.2 Termination by User
You may terminate your use of our services and, if applicable, close your account at any time by contacting us at [email protected] and requesting account deletion. Outstanding orders that have already been confirmed and are in preparation will still be fulfilled and billed.
14.3 Termination by Dions
We reserve the right, at our sole discretion and without prior notice or liability, to suspend, restrict, or terminate your access to our Site and services if:
- You have violated any provision of these Terms;
- We reasonably suspect fraudulent or unlawful activity on your account;
- We determine, at our discretion, that continued provision of services to you is not in the best interest of Dions or other users;
- We are required to do so by applicable law, court order, or government authority;
- We discontinue our services.
14.4 Effect of Termination
Upon termination of your access to our services, your right to use the Site ceases immediately. The following provisions shall survive termination of these Terms: Intellectual Property Rights (Section 6), Disclaimers (Section 9), Limitation of Liability (Section 10), Indemnification (Section 11), Governing Law (Section 12), Dispute Resolution (Section 13), and this Section 14.4, along with any other provisions that by their nature should survive termination.
15. Changes to These Terms
We reserve the right to modify, update, or revise these Terms of Service at any time and for any reason at our sole discretion. When we make material changes to these Terms, we will:
- Post the updated Terms on this page with a revised "Last Updated" date;
- Provide notice through our Site, via email to registered users, or through other reasonable means at our discretion.
Your continued use of our Site or services following the posting of any amendments constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must immediately stop using our services. We encourage you to review this page periodically to stay informed about our current Terms.
If we are required by applicable law to obtain your consent to any material changes, we will do so in the manner required by law prior to implementing such changes.
16. Privacy Policy
Your use of our Site and services is also governed by our Privacy Policy, which is incorporated herein by reference and forms part of these Terms of Service. Our Privacy Policy describes how we collect, use, store, and share your personal information. By agreeing to these Terms, you also acknowledge and agree to our Privacy Policy. Please refer to our Privacy Policy for details on how to exercise these rights.
17. Electronic Communications

18. Force Majeure
Dions shall not be liable for any delay, failure to perform, or interruption of services resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemic, epidemic, governmental actions, civil unrest, fire, flood, power outages, labor strikes, supply chain disruptions, internet or telecommunications failures, or any other event of force majeure. In such events, our obligations shall be suspended for the duration of the force majeure event, and we shall endeavor to resume normal operations as soon as reasonably practicable.

If you experience difficulty accessing any portion of our Site due to a disability or have suggestions for improving accessibility, please contact us at [email protected] so that we may assist you and work toward improving our Site.
20. Severability
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable for any reason by a court or arbitrator of competent jurisdiction, that provision shall be deemed severed from these Terms to the minimum extent necessary, and the remainder of these Terms shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving, to the greatest extent possible, the original intent of the parties as reflected in the original provision.
The failure of Dions to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future. A waiver of any provision of these Terms must be in writing and signed by an authorized representative of Dions to be effective.
21. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices, policies, or agreements published by Dions on the Site, constitute the entire agreement between you and Dions with respect to your use of the Site and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the same subject matter. In the event of any conflict between these Terms and any other policy or agreement published on our Site, these Terms shall govern unless otherwise expressly stated.
22. No Third-Party Beneficiaries
These Terms of Service are for the sole and exclusive benefit of the parties hereto — you and Dions — and are not intended to benefit, and shall not be enforceable by, any third party unless expressly stated herein. Nothing in these Terms shall create or be deemed to create any partnership, joint venture, agency, employment, or franchise relationship between you and Dions.
23. Assignment
You may not assign, delegate, or transfer your rights or obligations under these Terms, in whole or in part, without the prior written consent of Dions. Any attempted assignment without our consent shall be null and void.
